I. Call to Order

Board Member Lynn Fallin called the Board of Education (“Board”) General Business Meeting to order at 1:30 p.m. Board Members Bill Arakaki, Lynn Fallin, Ken Kuraya, Makana McClellan, Lauren Moriarty, and Kili Namauʻu were present.

Board Member Namau‘u moved to elect Board Member Fallin as chairman pro tem to preside over the April 20, 2023 General Business Meeting in the absence of the Board chairperson and vice chairperson. Board Member Kuraya seconded.

Board Member Fallin asked if there were any objections to the motion. No Board member raised objections, and the motion carried through unanimous consent from all members present (Board Members Arakaki, Fallin, Kuraya, Moriarty, and Namauʻu).

ACTION: Motion to elect Board Member Fallin as chairman pro tem to preside over the April 20, 2023 General Business Meeting in the absence of the Board chairperson and vice chairperson (Namau‘u/Kuraya). The motion carried through unanimous consent from all members present.


II. Public Testimony on Board of Education (“Board”) Agenda Items

Board Member Fallin called for public testimony.

Board Member Shanty Asher entered at 1:32 p.m.

Susan Pcola-Davis, member of the public, testified on agenda item III, entitled “Approval of Meeting Minutes of March 23, 2023 Special Meeting and March 23, 2023 General Business Meeting.” She shared a story and stated that plan, do, check, act is the basic transition process and stated that information relating to salary adjustments would help with the development of methodology.

Board members received written testimony before the meeting. (A listing of the people who submitted written testimony before the meeting is included at the end of these minutes.)


III. Approval of Meeting Minutes of March 23, 2023 Special Meeting and March 23, 2023 General Business Meeting

Board Member Fallin asked Board members to review the Board’s March 23, 2023 Special Meeting and March 23, 2023 General Business Meeting minutes.

Board Member Kuraya moved to approve the Board’s March 23, 2023 Special Meeting and March 23, 2023 General Business Meeting minutes. Board Member Namau‘u seconded.

Board Member Fallin asked if there were any objections to the motion. No Board member raised objections, and the motion carried through unanimous consent from all members present (Board Members Arakaki, Asher, Fallin, Kuraya, Moriarty, and Namauʻu).

ACTION: Motion to approve the Board’s March 23, 2023 Special Meeting and March 23, 2023 General Business Meeting minutes (Kuraya/Namau‘u). The motion carried through unanimous consent from all members present.


IV. Reports of Board Committees, Board Members, and Superintendent

Board Member and Investigative Committee Chairperson Fallin reported that the investigative committee was assigned with investigating issues relating to the nomination of individuals to serve as members of the State Public Charter School Commission (“Commission”). She stated that the committee is recommending the appointment of Makalapua Alencastre, Roger McKeague, and Lehua Veincent to the Commission for three-year terms, effective July 1, 2023, and ending on June 30, 2026.


Board Member Fallin referred to the written report on the events attended by Board members.


V. Public Testimony on Board Agenda Items

Board Member Fallin called for public testimony. No one testified at this time.


VI. Action Items

Board Member Fallin called on PJ Foehr, Interim Executive Director, State Public Charter School Commission, to provide the Commission’s recommendations on charter school requests for waivers from Board Policy 102-15, entitled “High School Graduation Requirements and Commencement.”

Foehr outlined the Commission’s recommendation on the waiver request for University Laboratory School, a Hawaiʻi Public Charter School​, (“ULS”) and​ Hawaii Technology Academy​ (“HTA”). He explained that because some charter schools have entered into new contracts with new terms, the Commission is again seeking Board approval of these charter schools’ requests to add to their graduation requirements. Foehr stated that Naomi Craft, Director of School Records, HTA is available online to answer any questions and that Denise Yoshimori-Yamamoto, Governing Board Chair, ULS and Keoni Jeremiah, School Director, ULS are here in-person.

Board Member Moriarty moved to approve the requests for waivers from Board Policy 102-15 for ULS and HTA for the term of each school’s respective charter contract, as described in Cathy Ikeda’s, Chairperson, State Public Charter School Commission, memoranda dated April 13, 2023. Board Member Arakaki seconded.

Foehr noted that the Commission recommended the approval of these waiver requests at its last meeting per the Board’s Policy.

Board Member Fallin asked for clarification on the term the waivers were in effect and the subject of the waivers. Foehr replied that waivers were granted for the term of the contract and that both schools are requesting waivers from Board graduation requirements.

Board Member Moriarty stated that she is the Board Chairperson designee on the National Association of State Boards of Education (“NASBE”) Government Affairs Committee, noted that states across the nation are reviewing graduation requirements to increase rigor and expressed appreciation that charter schools in Hawaii are leading the way.

Board Member Fallin called for a roll call vote on the motion. The motion carried unanimously with all members present voting aye (Board Members Arakaki, Asher, Kuraya, Moriarty, and Namauʻu).

ACTION: Motion to approve the requests for waivers from Board Policy 102-15 for University Laboratory School and Hawaii Technology Academy for the term of each school’s respective charter contract, as described in Ikeda’s memoranda dated April 13, 2023 (Moriarty/Namau‘u). Board Member Fallin called on Board Member Arakaki to present the recommendations for the School Community Council (“SCC”) requests for exceptions to collective bargaining agreements, statutory waivers, and waivers of Board policy for School Year 2023-2024.

Board Member Arakaki expressed appreciation to Department staff and representatives from the various unions for their work on the recommendation. He explained that Hawaii Revised Statutes (“HRS”) Section 302A-1124 to 1127, authorizes schools to request waivers from existing state agency rules, policies, regulations, procedures, collective bargaining agreements and provisions of Chapter 89, HRS.

Board Member Arakaki provided a summary on the waivers subject areas. He explained that the Hawaii State Teachers Association (“HSTA”) collective bargaining agreement, as it relates to teaching conditions and hours, department and grade level chairpersons and work year are included in attachments to the memorandum. Board Member Arakaki reported on statistics relating to the waivers, the top five most requested waivers, and major factors contributing to the increase of waivers.

Board Member Arakaki highlighted exception requests for Roosevelt High School, Kilohana Elementary School, and Kahakai Elementary School.

Board Member Arakaki detailed the exception review process and clarified that all of the exception requests were vetted by the SCC Exception Review Committee, which is composed of two Board designees and members of HSTA, bargaining unit 5. HGEA, bargaining unit 6 members also participated in the review process.

Board Member Arakaki outlined that the SCC Exception Review Committee’s recommendation addresses learning loss, social emotional needs, and strengthens instructional practices.

Board Member Kuraya moved to approve the SCC requests for waivers from collective bargaining agreement provisions, statutory provisions, and Board policies, as described in Board Member Arakaki and Tanimura’s memorandum dated April 20, 2023. Board Member Asher seconded.

Board Member Kuraya asked for an explanation of why schools are requesting to waive extra-curricular eligibility requirements. Kakesako explained that one school requested an exception that would not allow student athletes who have received an “F” to participate.

Board Member Moriarty asked whether the requests for exceptions to instructional hour requirements are beyond the collectively bargained 21 hours of professional development (“PD”). Kakesako replied that these requests represented time in addition to the 21 PD hours.

Board Member Moriarty asked about requests that would take away 24 hours or more of instructional time, requested more information on why lost instructional time is best for students, and whether the schools considered alternatives. Board Member Arakaki explained that schools are able to ask for waivers which take away instructional time from students because schools need to work with new teachers and review the curriculum and strategies, which helps students in the long run.

Board Member Moriarty stated that if schools can already use the collectively bargained 21 hours of PD, schools should target this time to address school needs instead of taking additional instructional time from students. Kakesako replied that the 21 PD hours are spread out and many waiver days include a full day of PD to provide more time for teacher collaboration. He noted that student instructional time is important, but additional hours for training also impacts student learning. Hayashi explained that PD oftentimes includes facilitators that address specific school needs, so having a full day is the best use of time.

Board Member Moriarty expressed interest in knowing how schools track how the additional knowledge gained by teachers through PD benefits students. She stated that she would like to have a common way to think about and address these issues in a systematic way that recognizes the needs of individual schools. Board Member Moriarty stated that if schools are requesting the same changes every year the Board should take a closer look.

Board Member Fallin stated that maximizing the number of instructional hours is critical and that with the new strategic plan it is a good time to review how SCC waiver requests impact all aspects of operations.

Board Member Fallin called for a roll call vote on the motion. The motion carried unanimously with all members present voting aye (Board Members Arakaki, Asher, Fallin, Kuraya, Moriarty, and Namauʻu).

ACTION: Motion to approve the SCC requests for waivers from collective bargaining agreement provisions, statutory provisions, and Board policies, as described in Board Member Arakaki and Tanimura’s memorandum dated April 20, 2023 (Kuraya/Asher). The motion carried unanimously with all members present voting aye.


Board Member Fallin stated that because negotiations with the Hawaii State Teachers Association (“HSTA”) appear to be nearly complete with the recent signing of a temporary agreement, it is not necessary for the Board to take further action on the authority of the person designated by the Board to conduct labor negotiations at this meeting.

Board Member Fallin expressed appreciation to Board Member Arakaki for his participation in the negotiations and many members shared about how much his participation was appreciated.


VII. Executive Session
This portion of the meeting was closed under Section 92-4 and Section 92-5(a)(3), Hawaii Revised Statutes.

Board Member Fallin stated that the Board would need to move into executive session to deliberate during the conduct of labor negotiations with the HSTA.

The Board recessed at 2:15 p.m. and reconvened at 3:04 p.m.


VIII. Adjournment

Board Member Fallin adjourned the meeting at 3:04 p.m.
