Cheri Nakamura, representing a group of equity in education advocates, testified on the Superintendent’s mid-year review of professional standards and Superintendent Priorities. Nakamura stated that she would like clear articulation regarding how priorities connect to system outcomes and what school designs are supposed to impact. She noted that the Department of Education (“Department”) has not addressed questions regarding system performance. Nakamura testified in support of extra compensation for classroom teachers but stated that she would like more information regarding accountability.

Baba Yim, Ke Kula Kaiapuni ʻo Ānuenue, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs. He detailed his background in Hawaiian immersion and explained how teachers leave as a result of lack of compensation.

Kaʻanoʻi Walk, ʻAha Kauleo, testified in support of extra compensation for classroom teachers in special education, hard-to-staff geographical locations, and Hawaiian language immersion programs. Walk urged the Board to advocate for classroom teachers in immersion charter schools.

Makamae Punohu, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs.

Uʻilani Pāʻaoʻao, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs and highlighted their experience in immersion classrooms.

Puʻuwai Kaeo, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs.

Kalola Kamahanohānuilanʻi, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs and described how extra compensation could help improve teacher retention.

Kalaʻi Walk, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs.

Osa Tui, Hawaii State Teachers Association (“HSTA”), testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs. He detailed his experience teaching in immersion classrooms and described how immersion teachers need to meet additional requirements in order to teach. Tui detailed the teacher shortage and how a lack of compensation negatively affects teachers.

Leinaala Vedder, member of the public, testified in support of extra compensation for classroom teachers and described how extra compensation would positively affect teacher retention and student outcomes.

Leilani Roberts, member of the public, testified in support of extra compensation for classroom teachers and detailed her experience teaching in the classroom.

Momi Vincent, member of the public, testified in support of extra compensation for classroom teachers in special education and described her experience as a special education teacher. Vincent explained why teachers are resigning and detailed how a lack of compensation negatively affects teachers and students.

Julia Fernandez, member of the public, testified in support of extra compensation for classroom teachers and detailed how low pay leads to a lack of teacher retention.
Lisa Morrison, member of the public, testified in support of extra compensation for classroom teachers and described how difficult it is for teachers to live on current salaries.

Vickie Kam, member of the public, testified in support of extra compensation for classroom teachers.

Kya Simpkins, member of the public, testified in support of extra compensation for classroom teachers and described her experience as a teacher. Simpkins detailed the difficulties of living in Hawaii on a teacher salary and urged the Board to consider extra compensation for teachers who relocate to Hawaii in order to improve recruitment and retention.

Corey Rosenlee, HSTA, testified in support of extra compensation for classroom teachers and detailed various issues, including hard-to-fill positions and a lack of qualified teachers. Rosenlee emphasized the importance of HSTA, the Department, the Board, and the community working together to end the teacher shortage and receive funding for education during legislative session.

Kealoha Akiu, member of the public, testified in support of extra compensation for classroom teachers.

Derek Govin, member of the public, testified in support of extra compensation for classroom teachers in special education and emphasized the importance of higher pay and qualified teachers.

Kahua Kauahikaua, member of the public, testified in support of extra compensation for classroom teachers.

Noelani Kauahikaua, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs and discussed teacher shortages and the additional requirements immersion teachers need to meet such as acquiring additional education.

Pahonu Coleman, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs and discussed the importance of immersion teachers.

Keokapukoa, member of the public, testified in support of extra compensation for classroom teachers in Hawaiian language immersion programs and emphasized the importance of immersion teachers.

Eomailani Kukahuko, University of Hawaii at Manoa, testified in support of extra compensation for classroom teachers in special education, hard-to-staff geographical areas, and Hawaiian language immersion programs, and detailed observations regarding teachers leaving the Department or teaching profession due to compensation.

Leimomi Kaʻaihili, member of the public, testified in support of extra compensation for classroom teachers in special education and Hawaiian language immersion programs and emphasized the importance of qualified and certified teachers.

Kaikaina Kekua, member of the public, testified in support of extra compensation for classroom teachers and noted the importance of the Department creating accountability measures and determining how to assess teachers, especially teachers in Hawaiian language immersion programs who need to meet additional requirements in order to teach.

Board Chairperson Payne stated that she wanted to clarify why the Board is using a different procedure for discussing the Superintendent’s evaluation. Under previous protocols, the Board conducted its mid-year formative assessment and end-of-year summative assessment of the Superintendent in executive session and then exited executive session to take action on the assessments in public. Following the completion of the assessments, the Board would publish its rating and comments on its website.

Board Chairperson Payne stated that on June 27, 2019, the Hawaii Supreme Court issued an opinion regarding discussion of personnel matters in executive session. Based on this opinion, the discussion of the Superintendent’s performance should occur in public because there is no clear, legitimate privacy interest in highly personal and intimate information, as described in the opinion.
Board Chairperson Payne commented that she has observed that the quality of meeting material submitted to the Board is poor. Other Board members have commented on this as well in their respective committees and during Board meetings. Board Chairperson Payne emphasized that the Department’s memoranda lack context and analysis. Oftentimes data is presented in isolation and explanations are nonexistent. Board Chairperson Payne further emphasized that material is not always organized effectively to where it is easy to follow. She noted that it is important for the Board to receive organized and clear material complete with explanations, analysis, and necessary data so that the Board is able to effectively perform its role.

Board Chairperson Payne stated that she would like to direct Board staff to create Board procedures and requirements for meeting material to ensure that Board members consistently receive high-quality memoranda and material moving forward. She noted that she would also like Board members to provide Board staff with comments on these procedures.

Board Chairperson Payne reviewed an update on the Superintendent’s evaluation for the 2019-2020 school year, including a mid-year review of professional standards and Superintendent Priorities. She detailed that the Board initially adopted a new Superintendent evaluation process in 2017. At the end of each school year, after completing the Superintendent’s final evaluation, the Board considers making changes to the evaluation process. The Board approved its last set of changes on June 20, 2019. One significant change that the Board made was to change the mid-year formative assessment from a full evaluation, similar to the end-of-year summative assessment, to a less intense mid-year review without ratings. She highlighted that the mid-year review still allows for a discussion on progress between the Board and Superintendent on meeting expectations without the burden of a full assessment, which the Board did not think was appropriate in the middle of the year.

Board Chairperson Payne stated that she would like discuss each standard and priority and have Board members provide the Superintendent with feedback and comments. She invited the Superintendent to respond to the comments and asked if there is any way that the Board could assist her with each of the standards or achieving priorities.

Christina Kishimoto, Superintendent, reviewed Superintendent Priority 1, which is to advance teacher leadership that empowers and enables teachers to make powerful and effective decisions that ensure student success. She noted that her first indicator, to develop and present a comprehensive leadership structure, is in progress. The Department’s focus has been to gather teacher input. She highlighted that the Department held a number of focus groups over the summer and during the beginning of the school year to receive teacher input around the areas of strength and development. The Department’s goal is to end the school year with a cohesive teacher leadership structure.

Kishimoto stated that the second indicator is to embed a comprehensive leadership development plan and the first phase of implementation of a $50 million literacy grant, which the Department received in the beginning of the school year. The first phase comprises of a rollout to complexes to support school plans to improve third grade reading, increase biliteracy rates, and focus on parent engagement.

Kishimoto stated that Superintendent Priority 2 is to advance equal access to school facilities and opportunities that align with school designs. She detailed the Department’s work around school design models and noted that the Department is ensuring that there are spaces that allow for flexibility or academy design within school design models. Kishimoto noted that the Department is focusing on facilities and compliance with Title IX and the Americans with Disabilities Act. She detailed how the Department is ensuring equity within facilities and further detailed the Department’s work to create a comprehensive plan to address its repair and maintenance (“R&M”) backlog. Kishimoto reviewed the indicator related to school design profiles and detailed that schools have worked on the concept of school design. She noted that school design is purposeful in terms of teacher training, curriculum, and so forth. She stated that the indicator is to provide school design profiles of 75% of all of the schools. Kishimoto highlighted that the profiles are meant to encourage schools to focus on purposeful planning.

Kishimoto reviewed Superintendent Priority 3 which is to improve funding allocation and use for special education and English learners (“EL”) programs by advancing system modernization for a replacement Financial Management System (“FMS”) and targeting special education and EL funding sources for accountability improvements. She stated that the first indicator focuses on the replacement FMS, which is in progress. The second indicator relates to financial guidelines for EL learners. She highlighted that the Board approved the Committee on Weights recommendations related to EL funding and further highlighted that the Department provided administrative guidance regarding EL program services and received feedback from Governor David Ige. Kishimoto detailed that the third indicator relates to the review of the Special Education Task Force’s recommendations. She noted that the Department has begun this work but it would take multiple years to fully implement all of the recommendations. She detailed that the Department is reframing how it distributes special education funds and working with principals.

Kishimoto stated that documents related to each indicator and progress on each indicator are available in the meeting materials. She noted that the Department has made progress on each indicator. Kishimoto stated that she would provide updates as the school year continues and would inform the Board if there was any delay on any indicator. She noted that some indicators relate to large and necessary operational re-designs, such as how the Department modernizes systems and determines funding, while other indicators relate to academics, school design, and teacher voice.

Board Chairperson Payne stated that the Board asked the Superintendent to be bold, make decisions that would move the education system forward in ways in which it has not moved forward in the past, and implement major system changes. She stated that the Board had to work closely with the Superintendent and Governor to receive funding for changes that must occur if the Department is to have a modern system. Board Chairperson Payne highlighted that progress is occurring in many areas.

Board Vice Chairperson Brian De Lima stated that sometimes Board members need summaries and short reports whereas in other instances the Board needs and expects detailed information. He stated that this depends on the topic at hand and the Department needs to be able to adjust accordingly. He noted that Kishimoto is sincere in her efforts to provide the Board with additional information in instances where the Board requests more information. He highlighted that Kishimoto is open, honest, and committed to providing students and families with the best public education system.

Board Vice Chairperson De Lima emphasized that Kishimoto is accomplishing many positive things but expressed concern that the Department has not addressed various areas related to special education, such as the Stetson study, whether schools are implementing Stetson, and how Stetson relates to staff development. He stated that he would like to learn more about this work and how it is improving the school system in regards to inclusion and instruction in the classroom. Board Vice Chairperson De Lima emphasized the importance of the Board accentuating the positive and simultaneously providing constructive feedback to help the Superintendent improve.

Board Vice Chairperson De Lima recognized Kishimoto’s responsibility working with a myriad of stakeholders, many of which monitor the Board’s activities. He stated that it is important for the Department to include these stakeholders when making decisions and to solicit advice and feedback from stakeholders who have an interest in public education and from those who attend the Board’s meetings and provide public testimony. He stated that the Department’s process for working with stakeholders would need to evolve. He noted that it is not necessary for the Department to automatically agree with every single piece of advice but it is important for the Department to explain its concerns and reasoning when it does not agree.

Board Member Bruce Voss stated that he would grade the second priority as incomplete because there is an enormous amount of work for the Department to complete. He noted that the Department is developing a comprehensive plan for its R&M backlog and tying its budget into school design. Board Member Voss expressed concern regarding school design portfolios. He stated that it is more important for school design portfolios to include input from teachers and school community members than it is for 75% of schools to complete portfolios. He noted that school designs should reflect the individual needs of school communities. Board Member Voss stated that the Department plans to present on school design portfolios in May 2020 and he is interested in reviewing the quality of school designs and whether the Department followed the Board’s guidance from three years ago regarding principal and school empowerment. Board Member Voss expressed concern regarding the upcoming legislative session and emphasized that the Department would need to continue to make progress in various areas.

Kishimoto stated that the Board previously agreed that the Department needed to shift some of its focus onto operational areas. She stated that the Department could continue to provide Stetson and other updates. She detailed that the Department started the school year by focusing on modernizing operations and modernization efforts include reviews of salaries and whether salaries are competitive.

Board Member Margaret Cox highlighted Kishimoto’s school visits and stated that her classroom visits and principal engagement during the complex area superintendent hiring process makes a difference at the school-level.

Board Member Kili Namauʻu expressed appreciation for Kishimoto’s work in the area of immersion education. She stated that she looks forward to the rollout of new ideas and future community meetings and highlighted that Kishimoto engaged, participated, and listened to community members at the Board’s most recent community meeting.

Board Chairperson Payne asked Board members to refer to their materials regarding extra compensation for classroom teachers in special education, hard-to-staff geographical locations, and Hawaiian language immersion programs. She stated that the Department is requesting approval to provide shortage differentials to qualified and licensed teachers to fill vacancies in the areas of special education, hard-to-staff geographical locations, and for Hawaiian language immersion programs. Board Chairperson Payne detailed that the recommended effective date for the shortage differentials is January 7, 2020.

Board Member Nolan Kawano stated that the Board should focus its discussion on extra compensation for each group of teachers. He suggested that the Board first focus its discussion on pay differentials for classroom teachers in Hawaiian language immersion programs because this pay differential has the smallest financial impact.

Board Member Kawano moved to approve to provide shortage differentials to qualified and licensed teachers to fill vacancies for Hawaiian language immersion programs as described in the Department’s memorandum dated December 5, 2019. Board Member Kaimana Barcarse seconded.

Board Member Barcarse asked about the status of Hawaiian immersion programs in charter schools and whether the pay differential applies to teachers in charter schools. Board Chairperson Payne explained that charter schools fall under a different set of rules and regulations and Board policies do not apply to charter schools unless specifically identified as applying to charter schools. She stated that it is important for Board members and the Department to have these discussions and determine ways in which to incorporate charter schools because charter schools struggling to meet the Board’s expectations. Kishimoto added that the Department’s proposal is for Department schools but the Department is committed to following up with the State Public Charter School Commission (“Commission”) to figure out the application and calculation of additional pay for Hawaiian immersion charter school teachers.
Kishimoto stated that the Department wants to ensure that it does not recruit from other areas of education and would meet with charter school decision makers to develop a comprehensive plan.
Board Member Kawano asked about differences in pay differentials for teachers in special education classrooms versus Hawaiian language immersion programs. Kishimoto explained that the Department calculated pay differentials for months and reviewed how to fit its request within the Governor’s budget. She stated that the Department wanted to ensure an immediate impact and plans to review pay differentials over time to determine whether it would need to make shifts or focus on teachers and positions that are not part of the first phase. She noted that the Department reviewed historical differential amounts of $10,000 that were available over a three-year rollout at one time.
Kishimoto detailed other historical differentials and stated that the Department wanted to focus on these three groups of teachers because these are the Department’s three largest priority areas. She explained that the Department calculated amounts that it would be able to fund over the next year and a half. She stated that the Department’s second phase would involve other groups of teachers. She highlighted that the Department reviewed different financial models and plans that would include as many teachers as possible while simultaneously addressing priority areas.
Board Member Kawano emphasized the importance of equity. He stated that the Department should fund Hawaiian language immersion teachers through its operating budget rather than basing these additional funds on the success of legislative requests. He stated that the Department’s memorandum does not provide enough information and the Department did not answer why or how it determined a pay differential for teachers in Hawaiian language immersion program that is $2,000 less than the pay differential for teachers in special education classrooms.

Board Member Kenneth Uemura agreed with Board Member Kawano. He stated that he supports the increases but asked if the Department believes pay differentials would make a difference in terms of recruitment and retention. He noted that the Department’s memorandum does not explain or estimate how the pay differentials would affect recruitment and retention. He stated that the Department needs to provide and request what it needs rather than what is available. To do so the Department would first need to determine what amount is necessary. He expressed concern that the Department is working backwards and expressed further concern that the Department did not justify its reasoning for providing Hawaiian language immersion teachers with an $8,000 pay differential rather than $10,000. Board Member Uemura detailed the difference between pay differentials and increases in base salary and asked if it would be more appropriate for the Department to increase its differential for Hawaiian language immersion teachers to $10,000. He stated that the Department’s memorandum explains that it would need to hire an additional 107 teachers to fill priority areas but noted that the Department’s increases might not lead to these outcomes. He emphasized the importance of the Department conducting studies and surveys to determine amounts.

Board Chairperson Payne highlighted that the University of Hawaii is implementing a Hawaiian immersion program to support the Department’s recruitment efforts. She stated that the Department’s requested salary increases and pay differentials could help recruit students into the program and help teachers stay in the system.

Board Member Uemura stated that his question is in regards to what amount would promote recruitment and retention and asked if $8,000 is the correct amount.

Board Member Cox commented that she supports the Department’s request. She stated that the Department’s proposal is a good start regardless of whether its pay differentials are the correct amount to promote recruitment and retention. She stated that the Department could determine increases and details in the future and highlighted collaboration between different entities.

Kishimoto stated that the Department engaged in multiple discussions and reviewed many considerations. She highlighted that the Department discussed a multiple phase approach with HSTA and determined the current amounts as a result of deciding on a multiple phase approach. She explained that the current proposal is the first phase and other phases include other partners and areas, such as housing, tuition access, and so forth. She highlighted that the Department needed to balance the multiple phases and take a bold first step.

Kishimoto stated that the Department reviewed the number of students in the highest achievement gap group which is special education and the number of teachers who are qualified to teach in special education classrooms. She stated that the Department’s proposal incentivizes these teachers to move from general education classrooms to special education classrooms and emphasized the effect pay differentials could have on students. Kishimoto explained that the Department provided the highest pay differential it could to teachers in Hawaiian language immersion classrooms. She stated that the Department would need to provide additional supports in other areas to increase the number of teachers in the education pipeline. She explained that there are non-certified teachers who wish to become certified and high school students who are considering whether to teach in Hawaiian immersion classrooms in the future. She stated that the Department’s proposal helps to incentivize these individuals. She emphasized that the Department reviewed multiple factors.

Kishimoto stated that the Department is not sure whether its proposed amounts will make a difference but it knows that historical differentials did not have a long-term impact. She stated that the Department’s plan to roll out $10,000 over three years in the past was not sufficient nor successful in the long-term. She noted that the Department reviewed national data regarding differentials that have had a long-term positive effect. Kishimoto highlighted that the Department plans to implement five measures to measure its impact and review whether the Department filled vacancies with licensed teachers, recruited new teachers, moved licensed teachers to special education classrooms, and increased retention rates in schools. She stated that the Department would share information regarding its measures with the Board in January and would review other incentives and supports it might need to implement.

Board Member Uemura stated that he looked forward to the Department’s report regarding its five measures. He asked if the Department has any estimates or forecasts regarding the effects of its pay differentials. Board Member Uemura asked about the Department’s plan if an $8,000 differential does not generate anticipated rates. He asked if the Department plans to increase its differential and by how much if this proposal does not have the expected outcome. Board Member Uemura emphasized the importance of these questions to ensure that the Department determined the amount that would make a difference. He stated that the Department should report on whether its proposal affects the achievement gap and vacancies. Board Member Uemura agreed with Board Member Kawano that the total amount for differentials for Hawaiian language immersion teachers is small and the Department should be funding this amount from its operating budget.

Board Chairperson Payne stated that it is unclear whether these differentials would make a difference or whether the Department would need to increase its differentials to have desired outcomes but this is a first step. She noted that testifiers support the Department’s proposal and have stated that they would consider teaching careers or consider filling vacancies as a result of these pay differentials. Board Chairperson Payne stated that the Department and Board would be able to review whether the pay differentials made a difference during the transfer period in January and could recalculate if the Department did not achieve its desired outcome. She emphasized that a teacher shortage and vacancies in priority areas would continue if the Board and Department do not take any steps.

Board Member Kawano stated that it appears as though his comments have been misunderstood. He clarified that the Department should implement pay differentials for Hawaiian language immersion teachers because Board policies require the Department to pay differentials to individuals who possess Hawaiian language expertise and teaching expertise rather than as a recruitment strategy. He stated that these teachers deserve pay differentials based on their skillsets which has nothing to do with recruitment. He emphasized equity and stated that Hawaiian language immersion teachers and special education teachers both possess highly qualified skill sets so there should not be a difference between the pay differentials for those two groups.
Board Member Kawano asked if the pay differentials are static or whether increases occur as salaries increase. He noted that the Department would need to include adjustment factors in its proposal so it does not need to reevaluate pay differentials in the future due to pay increases and inflation.

Kishimoto explained that the Department’s proposal is fixed and static at this time. She stated that the Department has engaged in discussions regarding how to phase in pay differentials and has considered basing differentials and other benefits on experience in the future. She noted that the Department hopes to have future conversations regarding competitive pay increases for all teachers. She explained that the Department is viewing the larger picture and would need to take first steps to reach its bigger goal. She noted that the Department would need a doable proposal that is difficult to argue against in order to reach other goals. She stated that the Department reviewed historical decisions and political context in terms of what would be an acceptable request and emphasized cohesion between the Department, HSTA, the Governor, higher education partners, and Kamehameha Schools. She stated that all partners agreed on the Department’s proposal and have started engaging in discussions with legislators. She explained that the Department tried to calculate and propose amounts that were bold and could lead to next steps while simultaneously not going so bold that it would be difficult to encourage buy-in.

Board Member Kawano stated that he does not oppose an $8,000 pay differential provided that the Department reviews $10,000 differentials in its second phase as it indicated it would. Kishimoto detailed accountability measures and emphasized the importance of including accountability in its data.

Board Vice Chairperson De Lima emphasized the importance of the Board asking questions, discussing, and vetting the Department’s proposal in order to support the Department during legislative session. He stated that the Department’s memorandum indicates that pay increases for teachers in Hawaiian immersion classrooms are not contingent upon legislative approval for the remainder of the fiscal year unlike other increases that are contingent upon legislative approval in future years. He stated that the Department compensating individuals with special skill sets that are not readily available would help with recruitment efforts.

Board Vice Chairperson De Lima emphasized the importance of the Department working collaboratively with HSTA and highlighted that this is the first time that the Department and HSTA have agreed on pay differential amounts during his time serving on the Board. He noted that historical pay differentials for hard-to-staff areas have not had desired outcomes. Board Vice Chairperson De Lima stated that Board members need to recognize the Department’s proposal as part of an overall plan to compensate teachers in a way in which there is a highly qualified and effective teacher in every classroom, including special education and Hawaiian language immersion classrooms. He noted that testifiers indicated that all teachers are underpaid and the Department is reviewing how to address these issues in the long-term. He stated that Board members are asking good questions and highlighted that the Department’s good leadership could address these questions, challenges, and issues.

Board Vice Chairperson De Lima emphasized the importance of HSTA and testifier support. He stated that there are some concerns regarding teachers who are not eligible for pay differentials but noted that the Department and HSTA are working collaboratively to address increases for other teachers as well.

Student Representative Daniella White stated that pay increases are necessary and detailed the high student to teacher ratio in Hawaiian immersion classrooms. She detailed her experience attending schools with high student to teacher ratios and noted that the topics of teacher shortages and low pay are come up often and are related.
Student Representative White emphasized the importance of Hawaiian immersion programs and keeping Hawaiian culture alive through curriculum.

Board Member Dwight Takeno commented that the Board’s policies require additional pay for Hawaiian language immersion teachers. He stated that this group of teachers is different from the other groups in the Department’s proposal because the Board mandates compensation for these teachers whereas Board policies do not address compensation for other groups.
Board Member Takeno commented that the Department’s total cost for the second half of the fiscal year would be $216,000. Moving forward the total cost has the potential to be $856,000 per year. He asked where this money would come from and whether the Department could guarantee it would be able to provide these amounts whether or not the Department receives funding from the Legislature or uses operational funds or another mechanism. Board Member Takeno stated that he wants to ensure that there would be continued funding once the Board and Department commit to this plan. He stated that he wants to further ensure that the Department would not pull these funds from programs, operations, or school budgets. He asked if the Department plans to use carryover funds or has set aside an available amount to fund its proposal this year. He asked if the Department plans to set aside $865,000 moving forward without affecting other programs.

Kishimoto stated that during a recent press conference, Governor Ige provided assurances that he would include the Department’s proposal in his biennium budget for this year and next for all three groups. She stated that the Department’s desire is to implement differentials in January 2020 to have it in place during the teacher transfer period and pursue other phases. She noted that the Department could absorb the pay differential for teachers in Hawaiian language immersion programs in its current budget. However, the Department would need to make adjustments to its budget and return to the Board for approval in order to fund pay differentials for all three groups. She stated that although it is a risk, it is necessary and important for the Department to provide pay differentials, especially considering capacity issues. She added that the Department could guarantee pay differentials for teachers in Hawaiian language immersion programs because the Department could absorb this funding through its salary savings. However, it would need to make adjustments to be able to fund other areas. The Department has reviewed its budget to determine ways in which it could make adjustments if the Legislature did not pass the Governor’s budget. She stated that the Department would miss implementation during the transfer period if the Board does not take action now. She stated that it is unacceptable to lose another year considering recruitment and retention challenges.

ACTION: Motion to approve to provide shortage differentials to qualified and licensed teachers to fill vacancies for Hawaiian language immersion programs as described in the Department’s memorandum dated December 5, 2019 (Kawano/Barcarse). The motion carried unanimously with all members present voting aye.

Board Member Uemura commented that the Department’s memorandum indicates that funding for pay differentials for teachers in Hawaiian language immersion programs would need to come from the Legislature but Board Member Kawano proposed that the Department fund this differential through its operating budget. Board Chairperson Payne explained that the Board’s policies regarding Hawaiian language immersion mandates salary adjustments.

Board Vice Chairperson De Lima moved to approve to provide shortage differentials to qualified and licensed teachers to fill vacancies in the areas of special education and hard-to-staff locations as described in the Department’s memorandum dated December 5, 2019. Board Member Cox seconded.

Kishimoto stated that the Department reviewed special education data regarding the number of certified teachers, the number of teachers working outside of their certification, and vacancy rates. She stated that the Department currently has capacity within its organization to fill special education classrooms with certified teachers and is seeking to incentivize teachers to return to these classrooms or work under their certifications. She detailed previous Board approval regarding the Department’s mentoring program and noted that this program provides support for special education teachers. Kishimoto detailed teacher contracts, tiers, and criteria levels. She explained that historically the Department has had challenges in filling vacant positions in these areas. She explained how the Department determined differentials based on criteria levels and further explained the Department’s proposal.

Board Member Voss stated that it would need to be made clear that this is the first step. He expressed concern regarding compression and stated that he looks forward to further discussion in January so that the Department could present the Legislature with a comprehensive package. He noted that there is a risk because the Department would need to move funding away from existing operations if the Legislature does not approve the Department’s requests. He emphasized the importance of the Department developing and providing real, specific, and accurate data to the Legislature. He stated that there will be consequences for other areas if the Department does not provide data to justify its decisions.

Board Member Kawano asked about pay differentials for hard-to-staff geographical locations. Kishimoto explained that the Department’s proposal reflects funding amounts for this year and next but the Department wants to continue funding this area as it moves forward.

Board Member Kawano stated that the Department’s memorandum specifically references funding for certain school years. He stated that the Department would need to provide clarification and be specific in terms of its intent. Board Chairperson Payne detailed the Department’s criteria and stated that the Department could work on providing clarification and technical adjustments.

Board Vice Chairperson De Lima commented that the Governor indicated that he would support the Department’s financial needs this fiscal year during his press conference and emphasized that the Governor’s support is an important component and provides the Department with the ability to immediately implement its plan. He stated that the Governor has the ability to adjust funding throughout various departments and the Board’s role is to make policy decisions. He stated that this is a critical decision that the Board needed to support. Board Vice Chairperson De Lima commented that the Department’s memorandum makes a distinction that pay differentials for Hawaiian language immersion teachers is not contingent on legislative support. He further detailed that the memorandum also indicates that the Department would request funding for future years from the Legislature via operational funds.

Board Member Takeno commented that the Department plans to implement pay differentials in January and noted that it could experience an influx of teachers during the transfer period. He noted that the total amount could cost the Department $30 million if funding is not made available. He asked how the Department would fund differentials in this instance and stated that at this point the Board and Department would have created an obligation to fund pay differentials. He stated that he would like more information regarding sources of revenues and specific effects on other programs so that Board members are fully aware of program impacts.

Kishimoto explained that the Department has reviewed various ways in which to meet this obligation. The Department would need to maximize funding through salary savings and review other non-school funding services. She stated that she could review funding models with the Human Resources Committee Chairperson and propose an approach to the Board, if necessary, that would include reviewing a five percent hold back at the state level to cover a certain percentage of the total. She stated that the Department would need to reprioritize its budget in order to prioritize pay differentials for the next year and a half.

Board Vice Chairperson De Lima commented that the cost for the 2020-2021 fiscal year is $29.5 million but the cost for the 2019-2020 fiscal year is $14.4 million. He noted that the Department would need to at worst fund $14.4 million through its operational funds if the Legislature or Governor did not provide the Department with funds.

Board Member Uemura noted that the Department indicated it could fund pay differentials for teachers in Hawaiian language immersion programs through operational funds but did not indicate how it would fund pay differentials for teachers in special education classrooms. He asked if the Department would fund this group through its operating budget. Board Member Uemura noted that the Department indicated that the Governor would provide $30.4 million in the next fiscal year. However, the Department would need to fund over $30 million each year moving forward if the Governor is not able to provide these funds. He emphasized that it is important that the Department provide the Board with accurate numbers and explain revenue sources for shortage differentials in the case that the Department does not receive additional funds.

Kishimoto detailed the Department’s five percent hold back. Board Chairperson Payne stated that she understands that the Department would need to provide additional technical information. She emphasized that each Board member would need to assist the Superintendent with outreach to help with funding and ensure that the Legislature supports the Governor’s budget.

Board Member Takeno stated that he wants to support the Department’s proposal and move forward but he would need to understand the financial implications if the Department does not receive funding. He stated that the Department would need to elaborate on its plan and suggested that the Department present its plan to the Board in a future meeting so that the Board could understand the Department’s next steps in the case that it does not receive funds. He stated that the Board could consider approval of the proposal after this presentation and retroactively compensate teachers to January. He stated that it is premature to approve a proposal without the understanding of financial implications and program impacts. Board Member Takeno emphasized that while he supports the Department’s proposal it would be helpful to receive a presentation and review this information. He reiterated that the Board’s approval could be made retroactive.

Board Chairperson Payne stated that the Department plans to present on its second phase of planning in January 2020. She stated that Kishimoto indicated that the Department would not take funds away from school-level programs to fund pay differentials if it does not receive funding from the Legislature and needs to fund differentials through its current budget. She stated that the Department indicated that it would review state office restrictions, salary savings, and other areas that would affect support services at the highest level but would not affect school funding. Board Chairperson Payne expressed concern that the Board would send a message to the field and to the Legislature that it does not support pay increases if it does not move forward and fully support the Department’s proposal. Board Chairperson Payne recommended that the Board move forward on voting with the expectation that the Department provide additional details and clarification to address concerns and questions in January.

ACTION: Motion to approve to provide shortage differentials to qualified and licensed teachers to fill vacancies in the areas of special education and hard-to-staff locations as described in the Department’s memorandum dated December 5, 2019 (De Lima/Cox). The motion carried with Board Members Payne, De Lima, Barcarse, Cox, Namauʻu, Uemura, and Voss voting aye, and Board Members Kawano and Takeno voting nay.
