*The Board did not meet at a physical location. As part of the response to the threat of COVID-19, Governor David Ige issued a Sixteenth Supplementary Proclamation dated November 23, 2020, suspending Hawaii Revised Statutes Chapter 92, Public Agency Meetings and Records, to the extent necessary to enable boards as defined in Section 92-2, to conduct meetings without any board members or members of the public physically present in the same location, among other things.

  1. Call to Order


Board Chairperson Catherine Payne called the Board of Education General Business Meeting to order at 1:31 p.m.

II. Executive Session
This portion of the meeting was closed under Section 924 and Section 925(a)(3) and (4), Hawaii Revised Statutes.


Board Chairperson Payne stated that the Board would need to move into executive session to deliberate on the authority of Board members authorized to represent the Board in mid-term bargaining and consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities concerning mid-term bargaining.

Board Member Barcarse moved to enter into executive session to deliberate on the authority of Board members authorized to represent the Board in mid-term bargaining and to consult with the Board’s attorney on the matter described on the agenda. Board Member Asher seconded.

Board Chairperson Payne asked if there were any objections to motion. No Board member raised objections, and the motion carried through unanimous consent from all members present (Board Vice Chairperson Uemura, Board Members Asher, Barcarse, Cox, Fallin, Namauʻu, Takeno, and Voss).

ACTION: Motion to move into executive session to deliberate on the authority of Board members authorized to represent the Board in mid-term bargaining and to consult with the Board’s attorney on the matter described on the agenda (Barcarse/Asher). The motion carried through unanimous consent from all members present.


The Board recessed at 1:34 p.m. and reconvened at 2:45 p.m.

Debra Kagawa provided oral testimony on behalf of Randy Perreira, President of the Hawaii Government Employees Association (“HGEA”). She testified on the Department of Education (“Department”) furloughs and stated that many employees woke up to hear about furloughs on the morning news because the Department never informed HGEA or made any attempt to negotiate prior to announcing the furlough plan to affected employees. Kagawa stated that Kishimoto lied when she said the plans were shared in a good faith effort with the unions and that the Department is in violation of Chapter 89, Hawaii Revised Statutes (“HRS”) for unilaterally implementing furloughs without collective bargaining. She stated mid-term bargaining should identify changes and negotiations as determined necessary and that HGEA will take necessary legal action and address the clear violation.

Christine Russo testified on Department furloughs and requested a future agenda item to discuss state assessments because states were denied a waiver for testing by the federal government for school year 2020-2021. She expressed concern about students physically returning to classes during a pandemic and that there should be clear guidance for those who do not feel comfortable sending their students to school. She stated that schools are struggling to recruit and retain educators and furloughs will create irreparable harm.

Mike Landes, testified on Department furloughs and said that the Governor chose to balance the budget on the backs of teachers and other state employees. He stated that he and his wife continue to teach because they love their students and community, but love cannot pay the bills or feed his children and at some point we need to think of the needs of our families. He stated that if their employer does not value them, they need to find another employer. He asked why furloughs are being pushed back into classrooms and how furloughs help the economy.

Rebecca Hadley, testified on Department furloughs and stated that she is unable to pay bills and furloughs is a slap in the face. She testified that she is considering leaving this state because she must balance the needs of students and her own family. The first furlough day is scheduled for January 4, 2021, typically a planning day, and now teachers will face students on January 5, 2021, which could result in confusion or chaos.

Corey Rosenlee, HSTA President, testified on Department furloughs and asked the Board to write a letter to the Governor and protect education for students. He testified that during the recession, budget cuts repressed student achievement, impacted teachers, and led to the teacher shortage crisis. Rosenlee testified that differentials made a dent in teacher shortages but every time there are pay cuts in education, it discourages those who want to become teachers. He stated that Governor Ige claims he has no choice, but this is not true; he has other options.

Sierra Mahin testified on Department furloughs and stated that furloughs would decrease the hours of valuable face to face learning time for her students. She testified that she has struggled financially on a teacher salary and works a part-time job to provide for her family.

Tai Baird testified on Department furloughs and stated that the single most important factor is the person at the front of the classroom. She testified that people are being discouraged from going into education and that she was informed that 11 positions will be affected at her school; furloughs will shortchange school and students.

Nico Friedman testified on Department furloughs and highlighted the impacts of furloughs and the sacrifices colleagues will need to make. He testified that he and his wife are both educators and urged the Board to consider the impacts on everyone.

Lisa Morrison testified on Department furloughs and asked the Board to pursue waivers from standardized testing requirements. She testified that she was has been informed that her position will be cut due to budget reductions and illegally imposed furloughs will force her to leave since she cannot afford to teach in Hawaii.

Cheri Nakamura, HE‘E Coalition testified on Department furloughs and expressed her surprise at Kishimoto’s announcement. She stated that that HE‘E Coalition has asked for device and connectivity data since April 2020 and no information was provided by the Department. Nakamura provided suggestions on how to determine gaps, literacy targets, and opposition to the proposal of using daily attendance instead of chromic absenteeism.

Susan Pcola-Davis testified in opposition to Department furloughs and stated that it was the result of relying on tourism. She stated that the Department does things their way and it should be a big red flag for the Board is that it is not allowed to comment on the budget. Pcola-Davis testified that it is disgraceful of Governor Ige to protect other essential employees and not teachers and pointed out that the Board should request a meeting with the Governor and show its support for education.

Amanda Lacar testified on Department furloughs and stated that Hawaii already has a shortage of teachers in the classroom.

Jodi Kunimitsu testified in opposition to the Department furlough plan and stated that furloughs are not only about money, they are also about respect for the teaching profession and the people you expect to save the public education system. She testified that teachers always put in more hours and use their own money while facing lower pay and no time to prepare a decent education for students. Kunimitsu stated that teachers are expected to deal with it and asked the Board to say “no” to furloughs.

Claire Barroga testified on Department furloughs and said furloughs will only widen the gap and cause regression and skill loss. She testified that teachers are the only occupation that goes through this.

Logan Okita testified on Department furloughs and stated that on November 5, 2020, he attended a meeting where a potential conceptual furlough plan was presented, but the Department did not notify employees of the final specific dates for furloughs.

Osa Tui, HSTA Vice President, testified on Department furloughs and stated that Kishimoto intends to violate contracts, questioned the authority the Board and Kishimoto has, and asked if contingencies are being developed.

Sarah Tochiki, testified on Department furloughs and asked if the Board values educators.

Vinny Byju testified on Department furloughs and expressed his concerned with the system. He testified that as a first year teacher from out of state, he feels it is important to hear from first year teachers since many are scared to speak out due to fear of losing their job. He testified that he feels disrespected beyond the financial aspect, that Hawaii cares but does not fund education and this becomes empty rhetoric and insulting.

Board Chairperson Payne expressed her concern about the financial crisis and its impact on the most vulnerable students.

IV.
Reports of Board Committees, Board Members, and Superintendent


Human Resource Committee Chairperson Dwight Takeno reported that the Committee received the Department’s short presentation on State Office functions and positions and stated that the Board can expect details from the complex areas and schools next month. He stated that the Human Resources Committee expects the Department to continually review this going forward.

V. Discussion Items


Stacey Aldrich, State Librarian, provided an update on her evaluation for 2020-2021 School Year: mid-year review of progress on State Librarian’s priorities. She reviewed her priorities: (1) implement new statewide service philosophy for consistent library service; (2) develop a cohesive strategy for virtual collections; (3) innovate services and management of resources around the new normal; and (4) create and implement a more robust strategy to get patron input and feedback.

Aldrich shared the dates by which she hoped to accomplish various priorities. She stated that she plans to successfully implement training of Service Philosophy by June 1, 2021. She stated that she is developing virtual collections using data to guide purchases so that they purchase items that are in demand and provide effective and efficient collections to the public.

Board Member Fallin asked how furloughs affect achieving the goals and objectives.

Aldrich stated that furloughs will definitely impact the amount of staff time and time to train staff. She explained that libraries have become like warehouses since most people are placing orders, which need to be put together, and that books are quarantined for five days, which slows things down. Aldrich stated that libraries would like to continue to do the training and implement the important priorities but with limited time, these goals may need to be pushed out into the future.

Board Vice Chairperson Kenneth Uemura echoed comments from other members. He stated that the priorities are on target to be complete by target dates, understood that furloughs may push some deadlines back, which is understandable. He stated that State Librarian Aldrich is doing a good job and reports are easy to follow.

Board Chairperson Payne thanked State Librarian Aldrich and her staff.

Board Chairperson Payne stated that the agenda item and her memorandum was prepared prior to the Department’s release of the furlough plan and also prior to the letter received this morning by Governor David Ige so some questions have been answered.

Board Member Voss stated that the Board and Superintendent do not have authority or control over furloughs, Governor Ige is responsible for addressing the budget shortfall. He stated that in fairness to Governor Ige, nobody knows what Congress will do although it appears likely that Congress may include a large amount of money for education spending in the upcoming stimulus bill. Board Member Voss stated that because of this, the Board needs to diffuse the situation and reduce the anxiety of teachers, staff, and families. He respectfully but strongly urged Governor Ige to immediately rescind his furlough directive so that mid-term collective bargaining can resume.

Board Vice Chairperson Uemura stated that the questions in the Board Chair’s memorandum are excellent and that they should be answered. He expressed his frustration since the Board has been left out of the discussion because Governor Ige worked directly with the Superintendent without any input from the Board. Board Vice Chairperson Uemura stated that he did not like the way this was done and deferred to Board Chairperson Payne. He suggested the Board send a letter to Governor Ige expressing its disappointment and asking him to rescind the furlough directive. Board Vice Chairperson Uemura stated that the public needs to know that the Board is not in support of furloughs and had no input on this.

Board Chairperson Payne stated that her memorandum was sent to the Governor’s office and the response was sent to Kishimoto, which answered some questions asked in her memorandum. Governor Ige indicated he has the authority to do this; however, it is important for the voices of Board members to be shared. She stated that she will follow up with Governor Ige to get an understanding of what is happening.

Board Member Fallin requested a copy of the memorandum sent out by the Governor and she asked when it was sent. Board Chairperson Payne responded that the memorandum went out today and should be in her email.

Board Member Fallin asked how much is projected to be saved under the Governor’s furlough plan. Kishimoto replied that the general projection for the Department for the Spring semester of 2021 is approximately $43 million, but there are no projections beyond that because the furloughs under Governor Ige’s Executive Order is only specific to Spring 2021 and anything beyond that will be a part of negotiations.

Board Member Fallin stated she is trying to gain a sense of the budget cuts since the Department already went through $100.3 million in cuts and for the next fiscal year the Department is being asked to cut another $104 million, so the $43 million furlough deficit is on top of the previous cuts. Brian Hallett, Assistant Superintendent of Office of Fiscal Services (“OFS”) confirmed her understanding and that based on the estimated amount of savings through the furlough, the Department of Budget and Finance would pull back the amount saved through furloughs to help balance the state budget.

Board Member Fallin stated that when looking at the Department’s budget for the next fiscal year including financial plans from the state, complex areas, and schools there are two kinds of budget adjustments, furloughs and a ten percent budget reduction. Hallett replied that is correct as we have seen in the Governor’s plan both adjustments are necessary.

Board Member Barcarse stated that he has also has not received communication from Governor Ige and he requested a copy. He suggested the Board go through the questions and what was answered so it has an understanding of what is still unanswered.

Board Chairperson Payne asked Board staff to provide the memorandum to Board Members. Regarding the question about the state public employee sector unions being included in discussions, she stated that it is her understanding that furloughs beyond June 30, 2021 are a part of negotiations. She stated that based on Governor Ige’s letter, he has the authority to impose furloughs based on his emergency powers. Board Chairperson Payne state that her understanding is that this will be litigated, based on testimony from HSTA. She stated that the Governor has the authority to impose furloughs unilaterally and that he worked with Kishimoto because he recognizes the Department is different from other state agencies. She stated that the number of furlough days for Department employees is less than for other state agencies and that Kishimoto has been working with Governor Ige to minimize the impact on students and teachers.

Kishimoto explained that the plan was part of the original discussion with the Board previously and it was not negotiated; it is being done under Governor Ige’s executive order. The letter to employees was sent out before winter break so they can plan as effectively as possible. She would like to reiterate public comments by Governor Ige that he will continually look at conditions and make adjustments.

Board Chairperson Payne stated that there are questions about the statute for student instructional days, that the Board has been informed that the law can be waived and that this will need to take place before the school year concludes.

Kishimoto stated that Board action on July 30, 2020, approving nine training days due to the COVID-19 situation, which reduced instructional days from 180 to 171. She further stated that the Board tabled any other action on reducing instruction days because there was an expectation that there would be continued negotiations this year to see if additional instructional days could be added, but the Board will need to take action on instructional days. Kishimoto suggested consulting with legal counsel on when the appropriate time will be to take action regarding impending furloughs and the loss of nine instructional days for training.

Board Member Voss shared his belief that Governor Ige should immediately rescind his furlough directive and enable the Department to resume mid-term bargaining. He stated that the reason the Board agreed to reduce the number of instructional days was in the hope that at least three of those days could be restored. He stated that good faith negotiations can resume if the furlough directive is rescinded and mid-term bargaining is resumed.

Board Member Fallin stated that a testifier asked to clarify how we count school hours for distance learning as it relates to student hours and the statute. Kishimoto asked Rodney Luke, Assistant Superintendent of the Office of Strategy, Innovation and Performance to respond. Luke explained student hours are calculated based on the hours in statute, then schools plan daily schedules, which ensure hours are preserved both for in-person and distance learning. Board Member Fallin stated that with distance learning, instructional hours (1,080 hours) are not just the hours that students receive instruction. Luke confirmed and stated it is not just calculated by student start and end times. Board Member Fallin expressed her concern about the impacts to students in terms of actual learning time and wants to ensure students get the time they are supposed to be provided.

Heidi Armstrong, Assistant Superintendent of the Office of Student Support Services (“OSSS”) stated that the virtual learning setting is different from the start of the school day to the end of the day. Board Member Fallin asked if a student is only doing 1-2 hours of distance learning, how the remainder of the day is accounted for. She also asked if there is a guidebook on what the student is doing on their own. Armstrong stated that there will be a schedule from the school.

Board Member Fallin asked if the principals monitor the plan and the hours being provided, because adding furloughs is troubling. Board Chairperson Payne stated that schools do this differently and the focus should be on furloughs instead of attendance and the hours.

Board Student Representative Hunter Harris stated that students are completing work while in class. He stated that as a student going through this, it is self-directed and the students are on their own making sure to do their work. He applauds teachers who are trying to make things interactive online for students.

Board Member Shanty Asher is concerned about students who are already suffering from challenges relating to distance learning. Her fear is will not be enough teachers to close in the gaps identified because we will have a lot of students lose credits, fall behind, and will not graduate. She hopes the furlough plan will not go through since students have suffered so much and she hopes education is prioritzied.

Board Member Kili Namau‘u expressed her frustration with how this came about because the Board was never a part of these discussions. She stated that she hopes to have a dialogue with Governor Ige because the Board does not sanction these furloughs, does not believe in them, and did not give any input. She stated that teachers have been struggling from before the pandemic and she would like to know what happens next year because respect has not been given to them.

Board Member Takeno expressed his frustration, like his colleagues, because time and time again the Board is caught off guard on actions taken without the Board’s consent and input. He also stated that Kishimoto clearly showed this is her plan and it was not shared with the Board. He stated that he holds the Department’s leader accountable and expects her to do better.

Board Chairperson Payne stated that the furlough plan was shared, but none of us expected it to hit this hard. She also stated that Kishimoto and Governor Ige have been in communication, but because of her advocacy he has reduced the furloughs.

Kishimoto thanked everyone for standing up for public education; it is important to have a unified voice and she will be accountable. She cannot do this alone the fact is at the end of the day we need funding that is predictable and adequate.

VI. Action Items


Board Chairperson Payne reviewed the findings and recommendations of the investigative committee tasked with developing the Board’s legislative policy positions and drafting any legislative reports due by the Board to the 2021 Legislature. She stated that the Board did not deliberate or act on the investigative committee’s recommendations at the Board’s last meeting at which the committee reported its findings and recommendations, pursuant to Sunshine Law.


Board Member Barcarse moved to (1) adopt the Board policy positions for the 2021 Legislative Session attached as Exhibit A to Investigative Committee Chairperson Catherine Payne’s memorandum dated December 3, 2020, and (2) approve the Board’s annual report on charter schools, pursuant to Section 302D-21, Hawaii Revised Statutes, and as attached as Exhibit B to Investigative Committee Chairperson Catherine Payne’s memorandum dated December 3, 2020. Board Member Cox seconded.

Board Member Uemura recommended to consider proposed legislation that preserves funding for high needs students by adding into the recommendation that the Department supports policy proposed legislation to preserve funding for students in the following categories: high needs/vulnerable, economically disadvantaged, and English learner (“EL”).

Board Member Uemura moved and Board Member Barcarse seconded.

Board Member Cox expressed her support for the proposed amendment.

Board Chairperson Payne suggested to adding “vulnerable students.”

Board Member Takeno acknowledged comments but does not know what the term “vulnerable students” means and would like the language to be more specific.

Board Chairperson Payne suggested adding language to the first legislative policy position following classroom level where to specify vulnerable learners as a priority including: high needs, economically disadvantaged, special education services, and EL.

Board Vice Chairperson Uemura moved to amend the main motion to change the first Department of Education policy position to state (new language in underlined), “The Board of Education (“Board”) supports proposed legislation that preserves funding and resources for student learning at the classroom level, including for our most vulnerable students who are economically disadvantaged, English learners, or receiving special education services.” Board Member Barcarse seconded.

ACTION: Motion to (1) adopt the Board policy positions for the 2021 Legislative Session attached as Exhibit A to Investigative Committee Chairperson Catherine Payne’s memorandum dated December 3, 2020, with an amendment to the first Department of Education policy position to state (new language in underlined), “The Board of Education (“Board”) supports proposed legislation that preserves funding and resources for student learning at the classroom level, including for our most vulnerable students who are economically disadvantaged, English learners, or receiving special education services”; and (2) approve the Board’s annual report on charter schools, pursuant to Section 302D-21, Hawaii Revised Statutes, and as attached as Exhibit B to Investigative Committee Chairperson Catherine Payne’s memorandum dated December 3, 2020 (Barcarse/Cox). The motion carried unanimously with all members present voting aye.


Kishimoto presented on the professional standards for the 2020-2021 School Year evaluation: (1) Visionary leadership and organizational culture; (2) Operations, resource, and personnel management; (3) Board governance and policy; (4) Communication and community relations; and (5) Equity Advocacy. For Priority 1, the focus will be on accelerating the Department’s digital transformation by decreasing the access gaps from 4.7 percent for the device gap and 13.8 percent for the connectivity gap. For Priority 2, the focus will be to promote innovative strategies to improve literacy at all grade levels as measured by decreases in the language arts gaps to 2.1 percent for elementary schools, 1.1 percent for middle schools, and 1.4 percent for high schools.

Board Member Cox asked if the Department will be getting grades for all schools by January. She is concerned about the number of seniors and 8th graders not moving onward unless something is done right now. She also stated that there needs to be minimal time to have students in school. Kishimoto replied that the Deputy Roundtable discussions gather this type of feedback.

Board Member Cox asked if Complex Area Superintendent’s (“CAS”) were asked to check what is happening in the schools. Kishimoto confirmed that they were.

Board Chairperson Payne asked for a motion before continuing discussions. Board Vice Chairperson Uemura moved to approve the Superintendent Priorities and strategic plan indicator targets as described in Superintendent Kishimoto’s memorandum dated December 17, 2020. Board Member Asher seconded.

Phyllis Unebasami, Deputy Superintendent, stated that there has been lots of discussions with schools and it depends on the school model. She stated that most schools are trying to stay within the hybrid learning model with advertised schedules shared with their school community.

Board Member Fallin stated that this is about students in the school learning and focusing on the statutory mandate; if the Department is asking the Board to waive instructional hours, there needs to be a system in place to feel confident. She emphasized Board Member Cox’s concerns and recommendations. She requested clarification on chronic absenteeism and how it is connected to what is happening nationally.

Kishimoto stated she will report on this metric and asked for consideration for the evaluation on areas that can see the most impact.

Board Member Fallin asked if the dashboard will collect data relating to chronic absenteeism. Kishimoto confirmed that it will.

Board Member Asher suggested tracking students who are constantly absent and look at how the teachers are delivering services.

Board Vice Chairperson Uemura thanked Superintendent Kishimoto for the priorities. He stated that he would like to get comfortable with the targets and indicators and asked if Kishimoto can respond to the HE‘E testimony. Kishimoto replied that the proposal is tied back to Board action and conversations. Kishimoto stated she would like to stay focused on the data from the 4th quarter.

Board Vice Chairperson Uemura expressed his interest in how the data was collected to address the gaps. He also stated that he is not sure if average daily attendance is important and Capital Improvement Priorities (“CIP”) is listed as an indicator but Kishimoto does not have direct control over this.

Board Member Voss asked if these targets are realistic in this environment, in particular the teacher retention rate, and whether Kishimoto thought the rate should be lowered. He stated that he would like Superintendent Kishimoto to be comfortable with the numbers the Board will use to evaluate her.

Kishimoto recommended to continue progress at a 2% rate for teacher retention.

Board Vice Chairperson Uemura stated that he was struggling with this, but the Board can amend indicators on items over which she has no control; however, using teacher retention rate from the number she proposed he did not agree with because she can always explain why she cannot meet the target. He stated that anything she can control should be left in and what she cannot control should be taken out.

Board Member Cox stated that the budget removed funding for the early college program so not much is left for schools. Kishimoto responded that the budget impact was for the 2021-2022 School Year, so targets make sense for this school year.

Board Vice Chairperson Uemura stated that the targets are acceptable, but they may need to be revisited in the 2022-2023 School Year.

Board Member Fallin stated that from a policy standpoint, discussion on metrics is critical to the Board’s ability to set priorities; metrics should be the Board’s guiding light in terms of how it will measure success. She stated that budgets and evaluations lead to metrics of some kind so the Board can describe to the legislature, community, and staff what success looks like and how we will get there.

Board Vice Chairperson Uemura moved to amend the main motion to remove the repair and maintenance backlog indicator from the strategic plan indicator targets. Board Member Barcarse seconded.
